Terms of sale and right of withdrawal

1. Scope and contracting party

These terms apply to purchases of artworks, editions and publications through the buy buttons on this website. Your contracting party is SNA – Studios New Amerika GmbH, Theaterstraße 66, 52062 Aachen, Deutschland, reachable at backoffice [at] timberresheim.com. Payment is processed by Stripe; the contract is concluded when payment is completed.

2. Prices and payment

All prices are in euros and include German VAT. Shipping costs are shown in the checkout before you buy. Payment is made through the methods offered by Stripe. For deliveries outside the EU, customs duties and import taxes may apply and are borne by the buyer.

3. Availability, editions

Works in a drop are available only for the period shown and in the quantity stated. For editions the buyer receives a numbered and, where stated, signed copy; the number is assigned by the studio. Images may differ from the original in colour and surface.

4. Delivery

Shipping is from the studio in Aachen within 14 days of receipt of payment, or within 30 days for editions produced to order; the studio informs you by e-mail when the work ships. Every work comes with a certificate of authenticity. For consumers, the risk of loss passes on delivery.

5. Right of withdrawal for consumers

Consumers have the right to withdraw from this contract within fourteen days without giving any reason. The period begins on the day on which you, or a third party named by you, take possession of the goods. To exercise the right, inform us of your decision by an unequivocal statement (by post to the address above or by e-mail to backoffice [at] timberresheim.com). Sending the statement before the period expires is sufficient.

Effects of withdrawal: We refund all payments received, including delivery costs (except additional costs arising from a delivery option other than the cheapest standard delivery), without undue delay and no later than fourteen days after receiving your withdrawal, using the same means of payment. We may withhold the refund until we have received the goods back. You must return the goods without undue delay and no later than fourteen days, and bear the direct cost of returning them; artworks must be packed appropriately and safely for transport. You are liable for diminished value only if it results from handling beyond what is necessary to establish the nature and characteristics of the goods.

Exclusion: There is no right of withdrawal for works made to the customer’s specifications or clearly personalised (for example commissions and special formats).

Model withdrawal form: “I hereby withdraw from the contract concluded by me for the purchase of the following goods: … Ordered on / received on: … Name and address of the consumer: … Date, signature (only if notified on paper).”

6. Warranty and copyright

Statutory warranty rights apply. Ownership of the work passes with the purchase; copyright and rights of use remain with the artist. Reproduction and publication require the artist’s consent.

7. Disputes, governing law

German law applies; for consumers the mandatory provisions of their country of residence apply in addition. We do not take part in dispute resolution before a consumer arbitration board.
